The inclusion of the customer&#039;s own terms and conditions is hereby objected to, unless otherwise agreed.<\/p><p><b>1.2<\/b>\u00a0These General Terms and Conditions apply accordingly to contracts for the delivery of vouchers, unless otherwise stipulated.<\/p><p><b>1.3<\/b>\u00a0A consumer within the meaning of these General Terms and Conditions is any natural person who concludes a legal transaction for purposes that cannot be predominantly attributed to either their commercial or independent professional activity.<\/p><p><b>1.4<\/b>\u00a0An entrepreneur within the meaning of these General Terms and Conditions is a natural or legal person or a partnership with legal capacity who, when concluding a legal transaction, acts in the exercise of their commercial or independent professional activity.<\/p><h2>2) Conclusion of contract<\/h2><p><b>2.1<\/b>\u00a0The product descriptions contained in the seller&#039;s online shop do not represent binding offers on the part of the seller, but are used to make a binding offer by the customer.<\/p><p><b>2.2<\/b>\u00a0The customer can submit the offer using the online order form integrated into the seller&#039;s online shop. After placing the selected goods in the virtual shopping cart and going through the electronic ordering process, the customer submits a legally binding contractual offer with regard to the goods contained in the shopping cart by clicking on the button that completes the ordering process. The customer can also submit the offer to the seller by email, online contact form or by post.<\/p><p><b>2.3<\/b>\u00a0The seller can accept the customer&#039;s offer within five days,<\/p><ul><li>by sending the customer a written order confirmation or an order confirmation in text form (fax or email), whereby the receipt of the order confirmation by the customer is decisive, or<\/li><li>by delivering the ordered goods to the customer, whereby the receipt of the goods by the customer is decisive, or<\/li><li>by asking the customer to pay after placing their order.<\/li><\/ul><p>If several of the aforementioned alternatives are present, the contract is concluded at the point in time at which one of the aforementioned alternatives occurs first. The period for accepting the offer begins on the day after the customer sends the offer and ends at the end of the fifth day following the sending of the offer. If the customer pays using a payment method offered by PayPal that can be selected during the online ordering process, the seller declares acceptance of the customer&#039;s offer at the moment the customer clicks the button that completes the ordering process.<\/p><p><b>2.5<\/b>\u00a0When submitting an offer via the seller&#039;s online order form, the contract text is saved by the seller after the contract has been concluded and sent to the customer in text form (e.g. email, fax or letter) after the order has been sent. The seller will not make the contract text available beyond this. If the customer has set up a user account in the seller&#039;s online shop before sending his order, the order data will be archived on the seller&#039;s website and can be accessed free of charge by the customer via his password-protected user account by providing the corresponding login data.<\/p><p><b>2.6<\/b>\u00a0Before bindingly submitting the order via the seller&#039;s online order form, the customer can identify possible input errors by carefully reading the information displayed on the screen. An effective technical means of better detecting input errors can be the browser&#039;s magnification function, which enlarges the display on the screen. As part of the electronic ordering process, the customer can correct his entries using the usual keyboard and mouse functions until he clicks on the button that completes the ordering process.<\/p><p><b>2.7<\/b>\u00a0Different languages are available for concluding the contract. The specific language selection is displayed in the online shop.<\/p><p><b>2.8<\/b>\u00a0Order processing and contact usually take place via email and automated order processing. The customer must ensure that the email address he provided to process the order is correct so that emails sent by the seller can be received at this address. In particular, when using SPAM filters, the customer must ensure that all emails sent by the seller or by third parties commissioned by the seller to process the order can be delivered.<\/p><h2>3) Purchase on trial<\/h2><p><b>3.1<\/b>\u00a0If you select the \u201cOrder for viewing\u201d option (purchase on trial), the contract is concluded on the condition that the customer receives the ordered goods within a period of fourteen days by express declaration (e.g. a letter sent by post, fax or e-mail). In this case, the buyer must transfer the agreed purchase price to the seller&#039;s bank account immediately, but no later than within seven days, unless otherwise agreed. The payment period begins on the day after the customer&#039;s declaration of approval or - if express approval is not given - on the day after the end of the approval period. The timely receipt of payment in the seller&#039;s bank account is decisive for meeting the deadline.<\/p><p><b>3.4<\/b>\u00a0If the customer declares rejection of the goods within the acceptance period, he must return the goods to the seller at his own expense within a period of seven days, unless otherwise agreed. The period for returning the goods begins on the day after the customer&#039;s declaration of rejection. To meet the deadline, it is sufficient for the customer to send the goods on time. The customer must use suitable transport packaging to avoid transport damage.<\/p><p><b>3.5<\/b>\u00a0If the customer culpably violates his duty of care and\/or return, he is obliged to compensate the seller for the resulting damage.<\/p><p><b>3.6<\/b>\u00a0The customer&#039;s statutory right of withdrawal is not affected by the aforementioned provisions.<\/p><h2>4) Right of withdrawal<\/h2><p><b>4.1<\/b>\u00a0Consumers generally have a right of withdrawal.<\/p><p><b>4.2<\/b>\u00a0Further information on the right of withdrawal can be found in the seller&#039;s cancellation policy.<\/p><h2>5) Prices and payment terms<\/h2><p><b>5.1<\/b>\u00a0Unless otherwise stated in the seller&#039;s product description, the prices stated are total prices and include statutory sales tax. Any additional delivery and shipping costs that may arise will be stated separately in the respective product description.<\/p><p><b>5.2<\/b>\u00a0For deliveries to countries outside the European Union, additional costs may arise in individual cases for which the seller is not responsible and which must be borne by the customer. These include, for example, costs for transferring money through credit institutions (e.g. transfer fees, exchange rate fees) or import duties or taxes (e.g. customs duties). Such costs may arise in relation to the money transfer even if the delivery does not take place to a country outside the European Union but the customer makes the payment from a country outside the European Union.<\/p><p><b>5.3<\/b>\u00a0The payment option(s) will be communicated to the customer in the seller&#039;s online shop.<\/p><p><b>5.4<\/b>\u00a0If you select a payment method offered via the payment service \u201cShopify Payments\u201d, payment is processed via the payment service provider Stripe Payments Europe Ltd., 1 Grand Canal Street Lower, Grand Canal Dock, Dublin, Ireland (hereinafter \u201cStripe\u201d). The individual payment methods offered via Shopify Payments are communicated to the customer in the seller&#039;s online shop. To process payments, Stripe may use other payment services to which special payment conditions may apply, to which the customer may be notified separately. Further information about \u201cShopify Payments\u201d is available online at <a href=\"https:\/\/www.shopify.com\/legal\/terms-payments-de\" target=\"_blank\" rel=\"noopener\">https:\/\/www.shopify.com<wbr \/>\/legal<wbr \/>\/terms-payments-de<\/a> available.<\/p><p><b>5.5<\/b>\u00a0If you select the purchase on account payment method, the purchase price is due after the goods have been delivered and invoiced. In this case, the purchase price must be paid without deductions within 30 (thirty) days from receipt of the invoice, unless otherwise agreed. The seller reserves the right to only offer the purchase on account payment method up to a certain order volume and to reject this payment method if the specified order volume is exceeded. In this case, the seller will inform the customer of a corresponding payment restriction in his payment information in the online shop. The seller also reserves the right to carry out a credit check when selecting the purchase on account payment method and to reject this payment method if the credit check is negative.<\/p><h2>6) Delivery and shipping conditions<\/h2><p><b>6.1<\/b>\u00a0If the seller offers to ship the goods, delivery will take place within the delivery area specified by the seller to the delivery address specified by the customer, unless otherwise agreed. When processing the transaction, the delivery address specified in the seller&#039;s order processing is decisive.<\/p><p><b>6.2<\/b>\u00a0If delivery of the goods fails for reasons for which the customer is responsible, the customer shall bear the reasonable costs incurred by the seller as a result. This does not apply with regard to the shipping costs if the customer effectively exercises his right of cancellation. If the customer effectively exercises the right of cancellation, the return shipping costs will be subject to the provisions set out in the seller&#039;s cancellation policy.<\/p><p><b>6.3<\/b>\u00a0If the customer acts as an entrepreneur, the risk of accidental loss and accidental deterioration of the goods sold passes to the customer as soon as the seller has delivered the item to the freight forwarder, the freight carrier or the person or institution otherwise designated to carry out the shipment. If the customer acts as a consumer, the risk of accidental loss and accidental deterioration of the goods sold is generally only transferred when the goods are handed over to the customer or a person authorized to receive them. In this case, no shipping costs will be charged.<\/p><h2>7) Retention of title<\/h2><p>If the seller makes advance payments, he reserves ownership of the delivered goods until the purchase price owed has been paid in full.<\/p><h2>8) Liability for defects (warranty)<\/h2><p>Unless otherwise stated in the following regulations, the provisions of statutory liability for defects apply. Deviating from this, the following applies to contracts for the delivery of goods:<\/p><p><b>8.1<\/b>\u00a0If the customer acts as an entrepreneur,<\/p><ul><li>the seller has the choice of the type of supplementary performance;<\/li><li>For new goods, the limitation period for defects is one year from delivery of the goods;<\/li><li>In the case of used goods, rights and claims due to defects are excluded;<\/li><li>The statute of limitations does not begin again if a replacement delivery is made within the scope of liability for defects.<\/li><\/ul><p><b>8.2<\/b>\u00a0The liability limitations and shortening of deadlines regulated above do not apply<\/p><ul><li>for claims for damages and reimbursement of expenses by the customer,<\/li><li>in the event that the seller fraudulently concealed the defect,<\/li><li>for goods that have been used for a building in accordance with their normal use and have caused its defects,<\/li><li>for any obligation of the seller to provide updates for digital products, in contracts for the delivery of goods with digital elements.<\/li><\/ul><p><b>8.3<\/b>\u00a0In addition, for entrepreneurs, the statutory limitation periods for any existing legal recourse claim remain unaffected.<\/p><p><b>8.4<\/b>\u00a0If the customer acts as a merchant within the meaning of \u00a7 1 HGB, he is subject to the commercial obligation to investigate and report complaints in accordance with \u00a7 377 HGB. If the customer fails to comply with the reporting obligations regulated there, the goods are deemed to have been approved.<\/p><p><b>8.5<\/b>\u00a0If the customer acts as a consumer, he is asked to complain to the deliverer about delivered goods with obvious transport damage and to inform the seller of this. If the customer does not comply with this, this will have no impact on his legal or contractual claims for defects.<\/p><h2>9) Redeeming promotional vouchers<\/h2><p><b>9.1<\/b>\u00a0Vouchers that are issued free of charge by the seller as part of promotions with a specific period of validity and which cannot be purchased by the customer (hereinafter \u201cpromotional vouchers\u201d) can only be redeemed in the seller\u2019s online shop and only during the specified period.<\/p><p><b>9.2<\/b>\u00a0Individual products may be excluded from the voucher campaign if a corresponding restriction results from the content of the campaign voucher.<\/p><p><b>9.3<\/b>\u00a0Promotional vouchers can only be redeemed before completing the ordering process. Subsequent billing is not possible.<\/p><p><b>9.4<\/b>\u00a0Multiple promotional vouchers can also be redeemed with one order.<\/p><p><b>9.5<\/b>\u00a0The value of the goods must be at least equal to the amount of the promotional voucher. Any remaining balance will not be refunded by the seller.<\/p><p><b>9.6<\/b>\u00a0If the value of the promotional voucher is not sufficient to cover the order, you can choose one of the other payment methods offered by the seller to pay the difference.<\/p><p><b>9.7<\/b>\u00a0The balance of a promotional voucher will neither be paid out in cash nor interest.<\/p><p><b>9.8<\/b>\u00a0The promotional voucher will not be refunded if the customer returns the goods paid for in whole or in part with the promotional voucher within the scope of his statutory right of withdrawal.<\/p><p><b>9.9<\/b>\u00a0The promotional voucher is only intended for use by the person named on it. A transfer of the promotional voucher to third parties is excluded. The seller is entitled, but not obliged, to check the material eligibility of the respective voucher holder.<\/p><h2>10) Gift Certificate Redemption<\/h2><p><b>10.1<\/b>\u00a0Vouchers that can be purchased via the seller\u2019s online shop (hereinafter \u201cgift vouchers\u201d) can only be redeemed in the seller\u2019s online shop, unless the voucher states otherwise.<\/p><p><b>10.2<\/b>\u00a0Gift vouchers and remaining balance of gift vouchers can be redeemed until the end of the third year following the year in which the voucher was purchased. Remaining credit will be credited to the customer until the expiry date.<\/p><p><b>10.3<\/b>\u00a0Gift vouchers can only be redeemed before completing the ordering process. For consumers, this choice of law only applies to the extent that the protection granted is not withdrawn by mandatory provisions of the law of the country in which the consumer has his or her habitual residence.<\/p><h2>12) Place of jurisdiction<\/h2><p>If the customer acts as a merchant, a legal entity under public law or a special fund under public law based in the Federal Republic of Germany, the exclusive place of jurisdiction for all disputes arising from this contract is the seller&#039;s place of business. If the customer is based outside the territory of the Federal Republic of Germany, the seller&#039;s place of business is the exclusive place of jurisdiction for all disputes arising from this contract if the contract or claims arising from the contract can be attributed to the customer&#039;s professional or commercial activity.
